Terms of Service

1. Acceptance of Terms
By accessing or using the AM Services America platform, website, mobile application, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
These Terms constitute a legally binding agreement between you and AM Services America ("Company," "we," "us," or "our").
2. Description of Services
AM Services America operates an online marketplace that connects customers ("Customers") with independent service providers ("Providers") for home and commercial services. We facilitate the connection between Customers and Providers but do not ourselves provide the underlying services.
Providers on the Platform are independent contractors, not employees, agents, or partners of AM Services America. We screen and verify Providers but are not responsible for the quality, safety, or legality of the services they perform.
3. User Accounts
To access most features of the Platform, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password confidential and not share it with third parties
- Notify us immediately of any unauthorized account access
- Be responsible for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms or our community standards.
4. Customer Terms
As a Customer, you agree to:
- Provide accurate information about service requests and your property
- Be present or make appropriate arrangements for scheduled service appointments
- Pay for completed services as agreed upon before or during booking
- Treat Providers with respect and professionalism
- Leave honest, accurate reviews of completed services
- Comply with all applicable local, state, and federal laws
5. Provider Terms
As a Provider, you agree to:
- Provide accurate information about your qualifications, licenses, and insurance
- Maintain all required licenses, certifications, and insurance throughout your time on the Platform
- Perform all accepted jobs to professional standards
- Arrive at scheduled appointments on time or communicate delays promptly
- Comply with all applicable local, state, and federal laws, including contractor licensing requirements
- Not solicit Customers to pay outside of the Platform for services originating through the Platform
- Maintain confidentiality of Customer information
6. Payments
All payments are processed through third-party payment processors. By using the Platform, you agree to the payment processor's terms of service. Service fees, Platform commissions, and payment timing are outlined separately in the applicable fee schedule.
Providers receive payment via ACH direct deposit following job completion, subject to the payment timeline specified in the Provider Agreement.
Customers authorize payment to be charged upon job completion or as otherwise specified during booking.
7. SMS Communications
By providing your phone number and opting in, you agree to receive SMS messages related to:
- Service request status and booking confirmations
- Provider dispatch notifications and estimated arrival times
- Job completion confirmations and invoice delivery
- Account alerts and security notifications
- Customer support communications

8. Provider Verification & Background Checks
We conduct background screening and credential verification on Providers as a condition of participation. However, we do not guarantee the accuracy of background check results or the current standing of any license or insurance policy. Customers should exercise their own judgment when allowing any service professional into their home or property.
9. Limitation of Liability
To the maximum extent permitted by applicable law, AM Services America shall not be liable for:
- The actions, omissions, or negligence of Providers
- Property damage or personal injury caused by Providers
- Any indirect, incidental, special, consequential, or punitive damages
- Losses arising from platform downtime, technical errors, or unauthorized access
- Any damages exceeding the fees paid by you to AM Services America in the 12 months preceding the claim
Providers carry their own liability insurance, which provides coverage for their work. Customers are encouraged to verify Provider insurance before authorizing access to their property.
10. Indemnification
You agree to indemnify, defend, and hold harmless AM Services America and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of another party.
11. Dispute Resolution
In the event of a service dispute, we encourage both parties to first attempt resolution directly. If unresolved, AM Services America's support team will review the matter and may mediate. For formal legal disputes, you agree to binding arbitration rather than jury trial, to the extent permitted by applicable law.
12. Intellectual Property
All content, trademarks, logos, and technology on the Platform are the property of AM Services America or its licensors. You may not reproduce, distribute, or create derivative works without written permission.
13. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated by reference into these Terms.
14. Modifications to Terms
We may update these Terms at any time. We will notify registered users of material changes by email or through the Platform. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by the laws of the United States and the state in which AM Services America is incorporated, without regard to conflict of law principles.
